5). The Services of REDLINE and its Website are provided on "as is" basis without any warranty, representation or condition of any kind with respect to Company's Services or Website. REDLINE disclaims all forms of guarantee, warranty, representation, or condition, expressed, implied, statutory or otherwise, insofar as is legally permissible, including, but not limited to, merchantability and fitness for a particular purpose.

Client acknowledges and accepts that REDLINE or any of its Representatives have NOT given any expressed, implied or any other forms of guarantee, warranty or representation that Company's Services will in any way guarantee, ensure or influence: a). Client's chances of application or admission to any educational or professional institution; b). Client's admission to any educational or professional institution or any other desirable result for Client academically or professionally; c) whether the Services will enhance, lessen, or divert from the strengths of Client's application. REDLINE disclaims any and all implied or expressed warranties, including but not limited to the Services' and provided materials' (essays, motivation letters, resumes, etc.) fitness for a particular purpose and Client's fitness for any application and admission to any educational or professional institution. Client acknowledges and accepts that REDLINE or any of its Representatives, as well as its contractors or partners, will NOT in any way be liable if Client fails to get admission to any educational or professional institution or program.

7). By using the Website or Services of REDLINE Client accepts to hold harmless, defend and indemnify REDLINE and its Representatives against any damages, losses, claims, liabilities, settlements, disbursements, expenses, costs and legal fees (including but not limiting to attorney fees), that might result directly or indirectly from a Third Party claim that originate out of Client's utilization of REDLINE's Website or Services, violation of REDLINE's Terms and Conditions of Use* or violation of Third Party's terms and conditions, or any other admission and application process outcome.

8). Neither REDLINE nor any of its Representatives will be liable for any damages resulting out of or in any connection with the usage of REDLINE's Services and Website. This is a comprehensive limitation of liability that is applied to any kind of the damages, including but not limited to direct, indirect, compensatory or consequential damages, loss of or damage to property, life or health damages, loss of income or data, and any claims of a Third Party.

9). Under no circumstances will REDLINE nor any of its Representatives will be liable for any kind of damages, including but not limited to direct, indirect, compensatory or consequential damages, loss of or damage to property, loss of income or data, and any claims of the Third Party, resulting out of any Client's rejection from any educational or professional institution. This does not apply in cases of intentional and / or grossly negligent behavior by REDLINE and to damages concerning life or physical integrity.

10). Under no circumstances will REDLINE be liable for any indirect, incidental, consequential, special, exemplary, multiple or other indirect damages arising out of the usage or inability of usage of any REDLINE's Services, Website or its content, even if REDLINE has been advised of the possibility of such damages or such damages can be reasonably foreseeable.

11). This Services Agreement or any of REDLINE's Services do not constitute an exceptional circumstance which justifies some kind of legitimate expectation of trust or reliance between the Parties in line with § 311 of the German Civil Code.

12). In no event shall REDLINE's total liability (whether for deliberate or grossly negligent action, breach of contract, breach of warranty, or otherwise) to Client for all damages, losses and causes of action resulting from Client's usage of REDLINE's Services or Website, exceed the Fees amount Client paid to REDLINE. Client acknowledges and accepts that all disclaimers and limitations of liability given in this Disclaimer of Warranties / Limitation of Liability are a crucial part of the Services Agreement between REDLINE and Client, and that REDLINE would have not accepted this Services Agreement without these disclaimers and limitations of liability.

REDLINE disclaims any responsibility for damage of any nature and Client warrants and accepts that REDLINE in no way will be held liable for any damages caused by Client's disclosure to the Third Party of personal information or materials regarding Client's identity, private information, or usage of REDLINE Services.

4). It is REDLINE's priority to secure and protect the data of its Clients. REDLINE commits itself to comply with the German Federal Data Protection Act ("BDSG") and the German Telemedia Act ("TMG").

5). Client agrees and accepts that personal information, including, but not limiting to contact details, resumes, cover letters, etc (together the "Information") will be saved by Redline to ensure the provision of Services. REDLINE shall be reasonably careful in protecting Client's identity, confidential information, or Client's relationship to Company during the provision of Services and not disclose this information to a Third Party unless: a). required by law; b). while trying to protect against or prevent actual or potential unauthorized transactions or fraud; c). investigating retrospective fraud; d). taking measures to collect unpaid invoices; e). required by Client him/her/itself. Should any confidential information be disclosed by REDLINE and should Client incur any consequential financial losses, Client's potential claim to REDLINE is limited to the Services Fees paid.

6). REDLINE is not liable for any damages caused by the information disclosure as a result of the illegal action of a Third Party.

7). Client is obliged and accepts not to share, disclose, distribute and keep in a strict confidentiality any Company information of a secret and confidential character (the "Confidential Information"), including, but not limiting to frameworks, worksheets, questionnaires, samples of written application materials or preparation materials, prices, or any other part of the REDLINE delivered Services under no circumstances in past, present and future, unless required by law or approved in writing by REDLINE. The materials and information that REDLINE shares with Clients is fully protected by copyright laws and any violation will result in a legal action and elimination of Client's eligibility for any Refund.

8). While Redline does its utmost to protect the privacy of its Clients and Website visitors, and to make its Website secure and reliable, REDLINE does not guarantee that all data remains confidential at all times. Thus, visitors of the Website and Clients acknowledge and accept: a). not hold REDLINE liable and responsible for making a secure internet transmission of any of the visitor's or Client's private data, or prevent attacks on REDLINE's IT systems; b). to be solely liable and at an own risk use the Website. REDLINE disclaims any guarantee or warranty that any data transmitted through this Website will remain fully confidential.

9). REDLINE's Website uses a web analytical tool Google Analytics by Google Inc. Google Analytics uses "Cookies" (small files that, if the website user allows, are transferred by the website or its service provider to the user's computer hard drive via the user's web browser, this allows the website or its service provider to recognize the user's browser and capture selected information).
